NeckCare™ acts as a business associate under the Health Insurance Portability and Accountability Act (HIPAA) for the healthcare providers (covered entities) that use the NeckCare™ Products. NeckCare™ has established and implemented policies and procedures designed to meet the applicable requirements of the HIPAA Privacy, Security, and Breach Notification Rules.

Business Associate Addendum

The NeckCare™ Business Associate Addendum forms part of the NeckCare™ Terms of Sale for customers that are covered entities and have not signed a separate business associate agreement with NeckCare™. It sets out how NeckCare™ may use and disclose protected health information (PHI), including the de-identification of PHI in accordance with HIPAA.

How we protect PHI

To protect the privacy and security of PHI received or created with the NeckCare™ Products, NeckCare™:

•  

  Has established policies and procedures following the HIPAA Privacy, Security, and Breach Notification Rules;

•  

  Has designated a HIPAA Privacy Officer and a HIPAA Security Officer, responsible for implementing and maintaining our HIPAA policies and procedures;

•  

  Has implemented administrative, physical, and technical safeguards to protect confidentiality, integrity, and availability of PHI;

•  

  Stores PHI in a secure, access-controlled database;

•  

  Ensures password and authentication management;

•  

  Maintains facility access control;

•  

  Controls and monitors access to PHI;

•  

  Restricts access to PHI to the minimum necessary for the stated purpose;

•  

  Requires HIPAA awareness training for all workforce members;

•  

  Requires extensive training for workforce members with PHI access;

•  

  Enters into business associate agreements with subcontractors that create, receive, maintain, or transmit PHI on our behalf.

We regularly review our policies, procedures, and safeguards and update them as needed.
